释义	法律分析：一定判实刑，醉驾,血液酒精含量240毫克/100毫升,即使无交通事故,也会被法院判处3个月左右的拘役。因为血液酒精含量超过200毫克/100毫升,属于从重处罚的情节,所以,是不能判处缓刑的,必须判处实刑。法律依据：《中华人民共和国刑法修正案》二十二、在刑法第一百三十三条后增加一条，作为第一百三十三条之一：“在道路上驾驶机动车追逐竞驶，情节恶劣的，或者在道路上醉酒驾驶机动车的，处拘役，并处罚金。“有前款行为，同时构成其他犯罪的，依照处罚较重的规定定罪处罚。”
