劳动保障和社会保障的差别

从劳动保障和社会保险的关系来看，前者以针对劳动者的弱势地位而设立，后者针对生活风险而建立，不考虑主体的差异，因此社会保险是劳动保障的内容之一，但不是全部。社会保险的关系主题是劳动者和用人者的时候，也才属于劳动保障的内容，两者是区别但是有交叉。
【法律依据】：
《劳动保障监察条例》 第二十二条 劳动保障行政部门应当建立用人单位劳动保障守法诚信档案。用人单位有重大违反劳动保障法律、法规或者规章的行为的。由有关的劳动保障行政部门向社会公布。
