释义	无房产证的房屋不能签订正规的租赁合同。公民、法人或其他组织对享有所有权的房屋和国家授权管理和经营的房屋可以依法出租，但是未依法取得房屋所有权证的、权属有争议的房屋不能进行出租。【法律依据】《商品房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：（一）属于违法建筑的；（二）不符合安全、防灾等工程建设强制性标准的；（三）违反规定改变房屋使用性质的；（四）法律、法规规定禁止出租的其他情形。
