释义	二审案件的审理方式分为书面审理和开庭审理两种方式。采取书面审理方式的条件是案情事实清楚。书面审理是相对于开庭审理而言的。书面审理采取依据上诉人提交的上诉状、被上诉人的答辩状以及听取有关当事人的意见后，通过审阅一审案卷材料进行审理，不须经过开庭审理程序就作出终审判决。采取书面审理的方式不排除审判人员为核实部分事实、弄清某个法律问题而进行必要调查。
