释义	动产抵押未登记的，抵押权是成立的，只是不能对抗善意的第三人。《民法典》第四百零三条规定：“以动产抵押的，抵押权自抵押合同生效时设立；未经登记，不得对抗善意第三人。”当事人以动产抵押的，抵押合同发生法律效力时，抵押权就成立了，跟是否办理登记没有关系，经过登记的，可以对抗第三人，没有登记的，不可以对抗善意的第三人。法律依据《民法典》第四百零三条
