释义	根据我国相关法律规定，2020年我国通过并颁布了民法典，其中并未对事实婚姻关系作出规定，但根据《关于适用新的〈婚姻登记管理条例〉的通知》可知，在1994年2月1日之后，我国已经不承认事实婚姻关系了，故不管同居几年都不会形成事实夫妻，但是如果双方中一方有配偶而以夫妻名义生活的，可能构成重婚罪。法律依据：《关于适用新的〈婚姻登记管理条例〉的通知》自1994年2月1日起，没有配偶的男女，未办结婚登记即以夫妻名义同居生活的，按非法同居关系处理。
