释义	盗窃未遂是不认为犯罪吗起草过程中，曾有意见提出，根据刑法规定，对于盗窃未遂的，依法都应追究刑事责任，只是可以从轻、减轻处罚，仅规定对3种情形的盗窃未遂应当追究刑事责任没有法律依据。经研究认为，《解释》第12条第(1)款的规定并无不妥：如行为人仅以数额较大的财物为盗窃目标，最终未能得逞，通常可以认为其行为属于刑法第十三条后半段规定的“情节显著轻微危害不大”，依法不应作为犯罪处理，可由有关部门给予行政处罚，一律追究刑事责任不符合宽严相济刑事政策。
