释义	沉默权包含两项内容：1、被告人有权拒绝回答追诉官员或法官的讯问，有权在讯问中始终保持沉默，司法警察、检察官或法官应及时告知犯罪嫌疑人、被告人享有此项权利，法官不得因被追诉人沉默而使其处于不利境地或作出对其不利的裁判；2、犯罪嫌疑人、被告人有权就案件事实作出有利于或不利于自己的陈述，但这种陈述须出于真实的意愿，禁止官员采用暴力、威胁等强制性手段致使被指控人违背意志作出有罪供述，法院不得把此情形下的供述作为定案依据。法律依据《中华人民共和国刑事诉讼法》
