释义	法律分析：劳动合同是劳动者和用人单位之间签订的。劳务合同是双方当事人处于平等的法律地位上签订的，一般是独立经济实体的单位之间、公民之间以及它们相互之间产生。它不同于劳动合同，从法律适用看，劳务合同通过民事法律调整，而劳动合同通过劳动法调整。法律依据：依据《中华人民共和国劳动合同法》第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
