释义	没有劳动合同是可以购买社会保险的，但在用人单位为劳动者申请参保登记时，社保局需要用人单位提供劳动者的劳动合同。《劳动法》第七十二条规定：“用人单位和劳动者必须依法参加社会保险，缴纳社会保险费”，《社会保险法》第五十八条规定，用人单位应当自用工之日起三十日内为其职工向社会保险经办机构申请办理社会保险登记”。由此可见，用人单位和劳动者缴纳社会保险费，是按照建立劳动关系确定的，而不是按照是否订立劳动合同确定的。只要建立了劳动关系，无论是否订立劳动合同，都必须依法缴纳社会保险。
