释义	法律分析: 逮捕是检察院批准或决定，法院决定，公安机关执行的，对犯有证据证明有犯罪事实，可能判处徒刑以上刑罚的犯罪嫌疑人、被告人在一定时间内完全剥夺人身自由的强制措施。逮捕必须同时具备以下三个条件： 1、有证据证明有犯罪事实； 2、可能判处徒刑以上刑罚； 3、确有逮捕的必要性。《刑事诉讼法》第七十九条对有证据证明有犯罪事实，可能判处徒刑以上刑罚的犯罪嫌疑人、被告人，采取取保候审尚不足以防止发生社会危险性，应当予以逮捕。
