释义	法律分析: 对一些在河道两岸或滩涂中进行耕种的土地经常与国家河道管理体制发生冲突，所以对河道历史最高洪水位以下的滩涂地，无论什么理由都属于国家所有，是国有土地，农村集体经济组织不可将该范围内的土地承包给农民。法律依据: 《中华人民共和国河道管理条例》第二十条有堤防的河道，其管理范围为两岸堤防之间的水域、沙洲、滩地(包括可耕地)、行洪区，两岸堤防及护堤地。无堤防的河道，其管理范围根据历史最高洪水位或者设计洪水位确定。河道的具体管理范围，由县级以上地方人民政府负责划定。
