释义	虽然《民法典》第一千零七十九条规定，因感情不和分居满二年，法院应准予离婚。但要离婚必须拿出证据来。在实践中，空口向法院陈述分居的事实往往是无力的，夫妻分居没有第三人和其他证据证明，双方各执一词，会导致法院无法认定或不予认定双方的分居事实，便不能适用双认定方分居两年以上的事实。因此处于分居状态的当事人应该留心收集分居期间的证据，如证人证言、另寻住所的租赁合同、新住址接收的信件，都可以成为证明分居的证据。
