释义	我国法律对比并没有具体规定，一般是各地自行规定的。依照有关规定，人口稠密、耕地较少、交通方便的地区，应当实行火葬；如果暂不具备条件实行火葬的地区，允许土葬。一般土葬没有抚恤金，有火葬的地区须一般持火化证领取抚恤金，没有火葬地方可以通过死亡证明领取抚恤金了。法律依据：《殡葬管理条例》第四条人口稠密、耕地较少、交通方便的地区，应当实行火葬；暂不具备条件实行火葬的地区，允许土葬。实行火葬和允许土葬的地区，由省、自治区、直辖市人民政府划定，并由本级人民政府民政部门报国务院民政部门备案。
