交警大队为准，公路载客汽车不得超过核定的载客人数，但按照规定免票的儿童除外，在载客人数已满的情况下，按照规定免票的儿童不得超过核定载客人数的10%；驾驶营运客车（不包括公共汽车）以外的其他载客汽车载人超过核对人数的20%以上的，罚款100，记6分。
【法律依据】：
《中华人民共和国道路交通安全法》第四十九条 机动车载人不得超过核定的人数，客运机动车不得违反规定载货。
