释义	我国法律没有规定离婚中的过错方需要放弃财产分割。如果过错方愿意放弃共同财产的分配的话，是可以的。因为离婚时，夫妻的共同财产是可以由双方协议处理的，也就是由双方协议决定共同财产怎么分配，一方自愿放弃所有共同财产也是可以的。《民法典》第一千零八十七条，离婚时，夫妻的共同财产由双方协议处理;协议不成的，由人民法院根据财产的具体情况，按照照顾子女、女方和无过错方权益的原则判决。对夫或者妻在家庭土地承包经营中享有的权益等，应当依法予以保护。法律依据《民法典》第一千零八十七条
