释义	法律分析：违法。违反土地管理规定行为处分办法第五条规定，行政机关及其公务员违反土地管理规定，滥用职权，非法批准征收、占用土地的，对有关责任人员，给予记过或者记大过处分节较重的，给予降级或者撤职处分节严重的，给予开除处分。有前款规定行为，且有徇私舞弊情节的，从重处分。法律依据：《党纪处分条例》第一百零九条非法占用、买卖或者以其他形式非法出让、转让土地使用权，情节较轻的，给予警告或者严重警告处分节较重的，给予撤销党内职务或者留党察看处分节严重的，给予开除党籍处分。
