释义	涉嫌构成盗窃罪，本案除非犯罪嫌疑人死亡，除此之外一般而言没有撤案的可能性。即使及时退赃退赔，取得被害人谅解，也只能是从轻处罚，不会撤案。撤销案件简称“销案”，司法机关终止刑事诉讼的一种方式。在中国，公安机关、国家安全机关和人民检察院对已经立案的案件，经过侦査认为不构成犯罪，或者依法不应当追究刑事责任时，应当作出撤销案件的决定，标志此案己不成立。被告人已被逮捕的，应当立即释放，发给释放证明。撤案由司法机关决定，非被害人可以选择。
