单位病退和个人病退待遇 |

法律分析：一、 企业职工病退：对经劳动能力鉴定委员会鉴定，已经完全丧失劳动能力的职工，如男性年满50周岁，女性年满45周岁，且缴费年限同上，可办理病退。病退属于退休的一种，可按月领取养老金。
企业职工退职：;如果年龄达到病退要求，但缴费年限不满15年或过渡期内缴费不满10年的，退职待遇一次性支付，并终止养老保险关系。
二、机关事业单位职工病退：对经劳动能力鉴定委员会鉴定，已经完全丧失劳动能力的职工，如男年满50周岁，女年满45周岁，且工作年限满10年及以上的，可办理病退。
三、企业和机关事业单位的退职人员按月领取退职生活费的，与退休人员一起，根据国家调整离退休人员待遇的文件中的相关规定调整退职生活费，但幅度会小于退休人员。
法律依据：《中华人民共和国社会保险法》 第十六条 参加基本养老保险的个人，达到法定退休年龄时累计缴费满十五年的，按月领取基本养老金。
参加基本养老保险的个人，达到法定退休年龄时累计缴费不足十五年的，可以缴费至满十五年，按月领取基本养老金；也可以转入新型农村社会养老保险或者城镇居民社会养老保险，按照国务院规定享受相应的养老保险待遇。
