释义	法律分析：广告侵权不适用过错推定原则，广告侵权适用过错责任原则。所谓过错推定原则，是指受害人在诉讼中，能够举证证明损害事实、违法行为和因果关系三个要件的情况下，如果行为人不能证明对于损害的发生自己没有过错；那么，就从损害事实的本身推定行为人在致人损害的行为中有过错，并就此承担赔偿责任的归责原则。法律依据：《民法典》第一千一百六十五条，行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
