释义	法律分析: 抗诉书不是给同级法院，是给上一级法院的。法律依据: 《中华人民共和国刑事诉讼法》第二百二十八条地方各级人民检察院认为本级人民法院第一审的判决、裁定确有错误的时候，应当向上一级人民法院提出抗诉。第二百三十二条地方各级人民检察院对同级人民法院第一审判决、裁定的抗诉，应当通过原审人民法院提出抗诉书，并且将抗诉书抄送上一级人民检察院。原审人民法院应当将抗诉书连同案卷、证据移送上一级人民法院，并且将抗诉书副本送交当事人。
