释义	房屋没有房产证的，是属于权属有争议的房屋，这类房屋是不能抵押的，所以抵押无房产证房屋无效，不能抵押给个人。法律依据：《城市房地产抵押登记管理办法》第八条下列房地产不得设定抵押： (一)权属有争议的房地产; (二)用于教育、医疗、市政等公共福利事业的房地产; (三)列入文物保护的建筑物和有重要纪念意义的其他建筑物; (四)已依法公告列入拆迁范围的房地产; (五)被依法查封、扣押、监管或者以其他形式限制的房地产; (六)依法不得抵押的其他房地产。
