释义	法律分析：宪法规定就是年满十八周岁的中国公民，没有被剥夺政治权利，身体精神状态可以参加选举。选举法规定，县级以上（不包括县级）的人大代表是间接选举的，就是通过下一级的人大选出来的，但是当选上一级的人大代表，不是必须是下一级人大代表，两者之间没有必然的关联性。法律依据：《中华人民共和国宪法》第三十四条中华人民共和国年满十八周岁的公民，不分民族、种族、性别、职业、家庭出身、宗教信仰、教育程度、财产状况、居住期限，都有选举权和被选举权；但是依照法律被剥夺政治权利的人除外。
