释义	法律分析：履约保证金不得超过中标合同金额的10% 法律依据：《中华人民共和国招标投标法实施条例》第五十八条招标文件要求中标人提交履约保证金的，中标人应当按照招标文件的要求提交。履约保证金不得超过中标合同金额的10%。如果中标人拒绝提交履约保证金，可以视为放弃中标项目(参见《招标投标法》第四十五条的有关规定)，应当承担违约责任。在这种情况下，招标人可以从仍然有效的其余投标中选择排序最前的投标为中选的投标，但招标人也有权拒绝其余的所有投标，并重新组织招标。
