释义	法律分析：如果对年幼的或者患病的孩童拒绝抚养，将其遗弃，情节恶劣，则具有扶养义务的人就构成遗弃罪。如果是将婴儿遗弃在荒无人烟的地方，或者一般人无法施救和察觉的郊外，导致婴儿因无人发现而死亡或者重伤的，不应构成遗弃罪，而应构成故意杀人罪或者故意伤害罪。法律依据：《中华人民共和国刑法》第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
