释义	买卖合同不属于实践合同。实践合同又称要物合同，是指除当事人双方意思表示一致外，还须交付标的物或完成其他现实交付才能生效的合同。而买卖合同，一般自双方签字(盖章)即生效，属于典型的诺成合同，不属于实践合同。法律依据:我国《建筑法》以及《城市房地产管理法》对“违章建筑”不予保护。若未按照相应法律规定的程序开发建设的建筑，不具有合法性。双方通过签订买卖合同进行交易，不具有合法性，应属于无效的合同。
