释义	若当事人不在合同中约定一方当事人死亡后合同效力终止或者不将一方当事人死亡约定为对方当事人可以解除合同的条件并且行使合同解除权，合同权利义务还应继续存在。法律依据：《中华人民共和国民法典》第五百四十三条当事人协商一致，可以变更合同。第五百四十四条当事人对合同变更的内容约定不明确的，推定为未变更。经公安机关交通管理部门调解，当事人未达成协议或者调解书生效后不履行的，当事人可以向人民法院提起民事诉讼。
