释义	法律分析：破坏婚姻第三者不受处罚，只有道德上的谴责。但是如果构成重婚罪的，则会被判处刑罚。有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。法律依据：《中华人民共和国刑法》第二百五十七条以暴力干涉他人婚姻自由的，处二年以下有期徒刑或者拘役。犯前款罪，致使被害人死亡的，处二年以上七年以下有期徒刑。第一款罪，告诉的才处理。第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
