释义	法律分析: 犯罪目的是行为人通过实施犯罪行为来实现某种危害结果的心理态度，是构成直接故意犯罪的必备要件之一。犯罪动机是指刺激、促使犯罪人实施犯罪行为的内心起因或思想活动。《刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第十六条行为在客观上虽然造成了损害结果，但是不是出于故意或者过失，而是由于不能抗拒或者不能预见的原因所引起的，不是犯罪。
