释义	法院制作调解书并送达双方当事人成功的，当事人不得再以相同的理由起诉，也不能上诉，否则构成重复起诉，违反一事不再理原则，浪费国家的司法资源。因为调解书的内容是在双方自愿的意思表示下达成的，除非当事人有证据证明调解书不自愿、不真实、不合法，否则不能再诉。【法律依据】《中华人民共和国民事诉讼法》第九十六条调解达成协议，必须双方自愿，不得强迫。调解协议的内容不得违反法律规定。第九十九条调解未达成协议或者调解书送达前一方反悔的，人民法院应当及时判决。
