释义	法律分析：偷录偷拍要作为合法证据使用，有三种限制：一是不得侵害他人合法权益，包括个人隐私以及个人的生活不受干扰等；二是不得违反法律禁止性规定。采取暴力、胁迫、非法拘禁、窃听等方法取得的证据，均不能作为诉讼证据使用。三是故意违反社会公共利益、社会公德的偷录偷拍行为，也在禁止之列。法律依据：《民事诉讼法司法解释》第一百零六条规定，对以严重侵害他人合法权益、违反法律禁止性规定或者严重违背公序良俗的方法形成或者获取的证据，不得作为认定案件事实的根据。
