释义	法律分析：根据我国法律的规定，保证期间分约定保证期间与法定保证期间。前者由债权人与保证人在保证合同中约定，后者是在当事人没有约定的情况下由法律直接规定，我国法定的保证期间是主债务履行期届满之日起6个月。保证合同对保证期间约定不明的，保证期间为主债务履行期届满之日起二年。法律依据：《中华人民共和国民法典》第六百九十二条没有约定或者约定不明确的，保证期间为主债务履行期限届满之日起六个月。
