船舶是可以被质押嘛
释义
我国《民法典》没有禁止船舶、航空器、机动车等特殊动产的质押，那么就应当认为，在其之上可以设立动产质押权。反对者认为，凡可以设立抵押的财产不宜设立质权，因为船舶、航空器、机动车等特殊动产可以设立抵押，就没有必要设立质押。法律依据:《中华人民共和国海商法》 第十一条 船舶抵押权，是指抵押权人对于抵押人提供的作为债务担保的船舶，在抵押人不履行债务时，可以依法拍卖，从卖得的价款中优先受偿的权利。 第十二条 船舶所有人或者船舶所有人授权的人可以设定船舶抵押权。
