释义	法律分析：我国的相关法律规定，一般情况下，出现以下三种情况之一的，行为人通常可以做无罪辩护：第一、被告并不是这个案件里面的犯罪行为人；第二、被告的行为是在正当防卫或紧急避险的基础上进行的；第三、行为人在搜集证据的过程中采取了不合法的手段，应当被排除，没有办法形成完整的证据链。法律依据：《中华人民共和国刑事诉讼法》第四十一条我国的辩护人认为在侦查、审查起诉期间公安机关、人民检察院收集的证明犯罪嫌疑人、被告人无罪或者罪轻的证据材料未提交的，有权申请人民检察院、人民法院调取。
