释义	法律分析：没有此说法。劳动者有严重违反用人单位的规章制度、严重失职、营私舞弊给用人单位造成重大损害等情形，用人单位可以解除劳动合同，辞退员工，不用支付经济补偿动者没有上述情形，用人单位违法辞退劳动者的，需要支付经济补偿，按每满一年支付一个月工资的标准向劳动者支付(违法辞退劳动者需要支付双倍补偿)。法律依据：《中华人民共和国劳动法》第九十八条用人单位违反本法规定的条件解除劳动合同或者故意拖延不订立劳动合同的，由劳动行政部门责令改正；对劳动者造成损害的，应当承担赔偿责任。
