释义	借婚姻索取财物，是指男女双方自愿或基本自愿结婚，但一方却以对方给付一定的财物作为结婚条件的行为，《民法典》明确规定，禁止婚姻当事人有借婚姻索取财物的行为。如果一方当事人有此行为，则另一方当事人可以通过诉讼的方式要求其返还原物，财物不能原物返还的，索要财物的当事人应折价补偿或赔偿。法律依据: 《中华人民共和国民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。
