包工头跑了,工钱可以向公司要吗

法律分析：包工头把工程款拿跑了，工人可以找公司索要。因为根据劳动法的有关规定，劳动者付出的劳动是在为公司工程，付出的应得的薪酬当然有公司支付。现在包工头卷款而去，属于公司用人不当所致，至于怎么向包工头追回，这是公司的事情。公司在向包工头追回款之前应该重新向工人垫付工资。
法律依据：《中华人民共和国劳动合同法》 第四十六条 用人单位应当向劳动者支付经济补偿。
