车上多一个三岁小孩算超载吗 |

法律分析：超载的。首先，普通轿车一般来说都是核载5人(含驾驶员)。所以如果驾驶、副驾驶位坐了人，那么后排按照规定只能坐3人。
三岁的孩子应该也有米以上了，所以，如果坐在后排，加上3个大人，后排算坐了4人，如果遇到交警检查，这种情况算超载。轿车一般分五座和七座的，五座严格按照要求只能坐五个人带驾驶员，七座也是一样。家用轿车副驾不准未成年乘坐。如果交警要求严格会被罚款扣分。
法律依据：《中华人民共和国道路交通安全法》 第九十二条 公路客运车辆载客超过额定乘员的，处200元以上500元以下的罚款；超过额定乘员20%或者违反规定载货的，处500元以上2000元以下的罚款。货运机动车超过核定载质量的，处200元以上500元以下罚款；超过核定载质量30%或者违反规定载客的，处500元以上2000元以下罚款。有前两款行为的，由公安机关交通管理部门扣留机动车至违法状态消除。运输单位的车辆有本条第一款、第二款规定的情形，经处罚不改的，对直接负责的主管人员处2000元以上5000元以下罚款。
