释义	法律分析：胁从犯，是指中国刑法中特有的共同犯罪人的一种。被胁迫参加犯罪的人。虽然参与了共同犯罪活动，但是受某种外来的力而被迫参加的，或者是因受蒙蔽而参与了犯罪，而且在共同犯罪中所起的作用比较小。因此，在共同犯罪人中，胁从犯所担负的刑事责任最小。中国刑法规定，对于胁从犯，应当按照他的犯罪情节，减轻处罚或者免除处罚。法律依据：《中华人民共和国刑法》第二十八条对于被胁迫参加犯罪的，应当按照他的犯罪情节减轻处罚或者免除处罚。
