释义	法律分析：捡到一万块钱不犯法，捡到一万块钱不上交，不归还有可能犯法，构成侵占罪。法律依据：《中华人民共和国刑法》第二百七十条拾遗拒不交出者,应处以徒刑、拘役和罚金。为防止拾得他人钱物而拒不归还,我国刑法设立了“侵占罪”,凡以非法占有为目的,将代为保管的他人财物或他人的遗忘物占为己有,数额较大、拒不退还或拒不交出的行为,就构成侵占罪。犯侵占罪,一般处二年以下有期徒刑、拘役或者罚金,数额巨大或者其他严重情节的要处二年以上五年以下有期徒刑。
