释义	劳动合同期限在一个月以下的，经双方协商同意，可以订立口头劳动合同，但劳动者提出订立书面劳动合同的，应当以书面形式订立。劳动合同一般以书面形式订立。根据《劳动合同法》68条至71条规定，非全日制用工，是指以小时计酬为主，劳动者在同一用人单位一般平均每日工作时间不超过4小时，每周工作时间累计不超过24小时的用工形式。人们通常所说的钟*工、小时工，按《劳动合同法》的规定叫作非全日制用工。非全日制用工双方当事人可以订立口头协议。非全日制用工双方当事人任何一方都可以随时通知对方终止用工。
