释义	法律分析: 认定针灸不算非法行医需要具有医疗机构执业许可证，同时从事针灸的人员具有医师资格。非法行医进行针灸的，责令停止非法执业活动，没收违法所得和药品器械，并处罚款。构成犯罪的，依法追究刑事责任。《中华人民共和国医师法》第五十九条违反本法规定，非医师行医的，由县级以上人民政府卫生健康主管部门责令停止非法执业活动，没收违法所得和药品、医疗器械，并处违法所得二倍以上十倍以下的罚款，违法所得不足一万元的，按一万元计算。
