释义	法律分析: 劳动合同存续期间，劳动者要求解除劳动关系的，应当提前30日以书面形式提交申请。由此给用人单位造成的损失，应当由劳动者赔偿。只要劳动者履行提前通知的义务，原则上无需用人单位同意。若用人单位迟迟不办理离职手续，劳动者可以通过劳动仲裁要求解除劳动关系。法律依据: 《中华人民共和国劳动争议仲裁调解法》第二十八条申请人申请仲裁应当提交书面仲裁申请，并按照被申请人人数提交副本。
