释义	法律分析：包括以下情形：1、违反法律强制性规定的情形，包括：违反国家法律、社会公德或者妨害公共利益的情形等；2、专利申请中的不合法情形：说明书没有充分公开发明或者实用新型；授权专利的权利要求书没有以说明书为依据;；专利申请文件的修改超出规定的范围等。法律依据：《中华人民共和国专利法》第五条对违反法律、社会公德或者妨害公共利益的发明创造，不授予专利权。对违反法律、行政法规的规定获取或者利用遗传资源，并依赖该遗传资源完成的发明创造，不授予专利权。
