释义	法律分析: 录音证据的质证可以从录音的真实性、合法性出发。若证明录音是偷录的或者录音侵犯他人的隐私的也属于非法的证据，不得采用。若证明录音是篡改、伪造或者无法确定真伪的，就不能再作为定案的根据。《最高人民法院关于适用〈中华人民共和国刑事诉讼法〉的解释》第一百零九条视听资料具有下列情形之一的，不得作为定案的根据：（一）系篡改、伪造或者无法确定真伪的；（二）制作、取得的时间、地点、方式等有疑问，不能作出合理解释的。
