释义	法律分析：算超员，已经坐了7个大人不能再抱一个儿童。车辆的载人数是以车辆行驶证上标明的核载人数为准，不是以乘车人员的身高、体重、年龄为准。所以，一辆核载7人的汽车，多出来一个儿童（即使是怀抱在父母怀中的婴儿）也属超员。法律依据：《中华人民共和国道路交通安全法》第四十九条机动车载人不得超过核定的人数，客运机动车不得违反规定载货。第九十条机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的，处警告或者20元以上200元以下罚款。本法另有规定的，依照规定处罚。
