释义	法律分析：国家对于违约责任作了明确规定，如明确了违约金及定金的，赔偿时可以选择两种条款的一种。但对于只明确了定金作为违约方式的，而赔偿的定金不足以弥补损失的，即使没有写明违约金，消费者也不用担心权益受损，只要能充分证明自己的实际可计算损失，可以要求经营者增加赔偿。法律依据：《中华人民共和国民法典》第五百八十八条当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
