释义	名词解释刑事抗诉的意思是人民检察院发现或者认为人民法院的判决、裁定确有错误时，提请审判机关依法重新审理并予以纠正的诉讼行为。地方各级人民检察院认为本级人民法院第一审的判决、裁定确有错误的时候，应向上一级人民法院提出抗诉。【法律依据】《刑事诉讼法》第二百九十四条人民法院应当将判决书送达被告人及其近亲属、辩护人。被告人或者其近亲属不服判决的，有权向上一级人民法院上诉。辩护人经被告人或者其近亲属同意，可以提出上诉。人民检察院认为人民法院的判决确有错误的，应当向上一级人民法院提出抗诉。
