释义	法律分析：不能。两者不是上下级的关系。凡是构成犯罪的形式案件都必须经过公安局和刑侦队的，派出所主要负责案件受理、立案，抓捕然后案子移交给公安局，公安局再次到提审，提审结果无异的话再移交给检察院，公安局一般案件必须在犯罪嫌疑人到案之日起37日以内必须向在关押的犯罪嫌疑人送达逮捕令，送达逮捕令后十五日内移交检察院。法律依据：《公安机关办理刑事案件程序规定》第十五条刑事案件应当到事发地的派出所或刑警队报案，派出所经初查属于刑警队管辖的，会移交刑警队。
