释义	法律分析：我国《劳动法》明确规定16周岁以下的，都属于童工。劳动法中最低工资标准等规定并不适用于暑期打工的学生，但根据公平原则一般不应当低于当地最低工资标准。法律依据：《中华人民共和国未成年人保护法》第三十八条任何组织或者个人不得招用未满十六周岁的未成年人，国家另有规定的除外。任何组织或者个人按照国家有关规定招用已满十六周岁未满十八周岁的未成年人的，应当执行国家在工种、劳动时间、劳动强度和保护措施等方面的规定，不得安排其从事过重、有毒、有害等危害未成年人身心健康的劳动或者危险作业。
